The Illinois Wage Payment and Collection Act requires employers to pay employees the wages they have earned and also requires employers to pay departing employees their final wages, including vacation time, within certain time frames.
Employers cannot discriminate against their employees based on race, sex, religion, national origin, physical disability and age. Discriminatory practices include bias in hiring, promotion, job assignment, termination, compensation, retaliation, and various types of harassment.
The Fair Labor Standards Act establishes a national minimum hourly wage, establishes certain protections against child labor, and requires employees who are not exempt from coverage to be paid a premium wage for all hours worked in excess of 40 hours a week.
The Illinois Minimum Wage Act establishes a state minimum hourly wage and mandates that covered employees be paid an overtime premium for all hours worked in excess of 40 hours a week.
